Witness Statement Discrepancy in Jessica Wheeler Murder

Alan D Elsdon’s book, Broken & Betrayed  (pg 279 – 282) describes the affidavit and the witnessing by JP of Victoria’s murder.  JP is the son of Mr Kobus Mienie, the bakery van driver who allegedly saw Heini at the churchyard in town in the early hours of the morning of the murder.  According to affidavits and cell tower reports, Heini was at home at Hornlee at 2.25am on the morning of the murder so could not have been at the crime scene at the same time.  According to JP, his father murdered Jessica.  Heini allegedly held Victoria’s legs while Kobus pinned her to the ground on her stomach, with his knees in her lower back and his hands on her head.   Thereafter, he made a phone call at around 3am in the morning.  Now if this call was made at 3am, and Heini was at home at 2.25am, he cannot have been at the crime scene.    JP did not take a polygraph test.  Heini also allegedly had a red top on.  He actually wore a grey Nike top.  His red jacket he had forgotten in the nightclub “Stones”, which he collected the next day.  JP was 14 years old at the time and the affidavit taken by Alan was ten years after the fact.  JP also did not do a polygraph test and it is a known fact that JP is a drug addict and has a criminal record that is fairly long. 
JP’s statement contradicts the car-guard, Jaco Kiewiets’ statement and who passed a polygraph test according to the first private investigator on the scene, Christain Botha, in his book, Search for Truth. 
Franklin van Rooyen actually introduced Alan to JP and JP never said anything to Franklin that Heini was at the crime scene at the church yard.   JP's father, Kobus Mienie and Inspector Burmeister (SAPS) are family and he knows everything about JP and Kobus’s involvement in the drug-trade.
In 2010 an inmate also gave a sworn statement in front of a magistrate in Mosselbay confessing his involvement with the Victoria Stadler murder in Noetsie forest and the police and NPA dismissed it as well.

News from the Inside of Prison

A search was conducted in the reception room where Heini and 17 other inmates were sleeping.  This was on the morning of 2 September 2018.  Heini was physically searched three times and nothing was found on him.   However, various unauthorized items such as a spiral plate, a cooking pot, 1g marijuana, broken cell phones, and steel cutlery were found in various places in the room.

At around 14h00, Heini was called to the management office where three members he knew and a Section Head Captain of B Unit whom he did not know was present.  One member started reading the submission of the offense and Heini immediately asked him if this was an investigation or a hearing.  He was told that it was an informal hearing.  Heini then responded by stating that he had had no chance to plea on the allegations and if he pleaded not guilty, it should then not be an unofficial hearing.  He was told that that decision was theirs to make and that he should not tell them how to conduct matters.

Heini asked for 7 days to go through all the relevant documents so that he could prepare for the hearing.   Again he was told that it was an informal hearing and that he should not waste their time.  He was told that the statements given by members involved were satisfactory and that he was found guilty of possession of unauthorized articles.   He again asked if he could challenge the allegations or post questions and he was simply told that it was an informal hearing and that it was not needed.  The members then all laughed.

A member gave him a reprimand.  Heini asked if that was his sanction and he was told yes.  He was told to choose another room to sleep in.  He first refused as it was not part of his sanction and not a prescribed sanction according to the Correctional Services Act 111 of 98 but told them he would move into F-section because it was a safe-keeping section and he would still be able to fulfill his study requirements.  However, one member told another to forcefully remove his things from the safety cell he was in.   He was moved to B8 which is not a school room and not conducive for study purposes.

He has written an appeal based on un-procedural actions by the officials, requesting the matter be resolved because whatever is written in his file has a direct influence on whether he stays in prison or not.    There is no further information on this situation.  Is this fall out from Alan D Elsdon’s book, Broken & Betrayed which covers the framing of Heinrich in the 2005 murders of Jessica and Victoria?

Heinrich van Rooyen - Botched Evidence in Trial

Four days after Victoria Stadler went missing, Director Trollip in Cape Town made himself available. Four days later, on Tuesday 15 November 2005, the partly decomposed body of Victoria was found in the Noetzie bushes on the outskirts of Knysna. After Trollip was contacted, he instructed forensic expert Supt Johannes to assist. This is the same FSL expert who assisted Capt Bruce in the Inge Lotz murder (where Fred, her boyfriend) was acquitted). Trollip then went to Knysna where he became the overall coordinator in Jessica and Victoria’s murder investigations. On Thursday 17 November, Heinrich van Rooyen, a local JD was arrested as a suspect in both murders. On Instruction from Trollip, Heinie’s blood was drawn “for DNA testing’. On Saturday 19 November, 20065, Heinie was released.
Also on Saturday 19 November 2005, four days after many thorough searches of the area by local and other Eastern Cape officers, including the canine unit, the police “found’ Victorias pants and underwear in the Noetzie bushes, only three meters from where her body had been found.
My conclusion: What kind of police work is this? How come they took four days to find clothing belonging to Victoria lying only 3 meters from where her body was found? Planted by the cops?? Planted by Attie Trollip? And why did the defense not follow up this very vital piece of evidence in the trial?

My Christmas Prison Visit

Maybe most prisoners only get visits at Christmas time because today was ordeal far greater than previous visits – the lines of visitors stretched as far as the eye could see, all waiting to get to the first check-in.  After that, there is a bus ride to the section the prisoner you are visiting is in.  I don’t do the bus ride because I can’t and have a special dispensation (asked for) allowing Patrick to drive me to Medium B.  From there it is into a reception area where you are searched and then you take a seat and one by one the visitors have to sign in again.  When the prisoner is in the visitor’s area, the visitor is called and allowed in.   This is a new method of visiting and I cannot say that it is an improvement on the previous method.  
Both Luvuyo and Heini were happy to see us – and extra happy with what we were able to take in for them.  However, my Xmas card had to be opened and censored which I think is rather pathetic, given that it was a home-made card that was very rude – it was made especially to make them laugh.  
While I visited with the boys (they so much younger than I am), Patrick went to buy them a cold drink which can only be bought at the prison tuck shop.  It took him 45 minutes to get the cold drinks…the queues were that long.   The prison is bristling with Quick Response teams very heavily armed with bulletproof vests and dogs.  The atmosphere was far from being one of a happy time.
I asked if they would be given a special meal on Christmas day – both of them said that they would be given rice.  They get no rice the whole year, except on Christmas day.   How sad is that?
Heini told me a very funny story which I am still laughing about.  The wardens’ love curried prawns but their wives don’t cook it for them, so they get Heini to cook it for them.  Heini has made a little stove which he used in his cell before he was moved to a communal cell a month ago.   He was busy cooking the curried prawns when at 2am in the morning; the tactical team came to do a search.  As fast as he could, he grabbed the pot with its glass lid and shoved it under his bed.  The biggest of the members of the tactical team was also the leader and he could smell the food.  He leaned down and pulled the pot out from under Heini’s bed.  When he saw the gogo’s (insects) through the glass lid, he got such a fright he pushed and shoved the other members out of the cell … shouting with fright.  Heini was not punished for cooking in his cell, but another prisoner who they were after anyway, was charged with cooking.   Can you imagine such a sight?  I laughed when Heini told me the story until the tears were running down my cheeks.   And just then, that same leader of the tactical team walked past us.  I laughed even more at that, seeing such a big man running for his life from a pot of prawns.

A huge thank you to Patrick, for my Christmas present…of taking me to the prison.  It is a present that I will remember for the rest of my life.

Christmas In Prison

My Christmas Gift
My husband, Patrick, has been in prison more than once for the “terrible” crime of having a bit of dope on him.  He spent too many years behind bars and has a phobia about the sounds, smells, and walls of a prison.
For Christmas, he asked me what I wanted.  I asked him to take me to the St Albans prison so that I could wish some prisoners a happy Xmas and take them some of what they need and are allowed.  This is the greatest Christmas gift from Patrick; for he is giving me his time and taking me to where he does not like to be.  I am very grateful to him for doing this.  Not only does he have to take me, but he has to take the wheelchair, oxygen cylinder, and facemasks and push me quite a distance to the visitor’s lounge.   The one hour visit we are allowed can sometimes take 5 hours with all the red tape and wait one has to do to see the prisoner.
I am going to see Heinrich van Rooyen and Luvuyo Lukas – two of many of my favourite prisoners in Medium B.  I am well acquainted now, after 2 years of visits, with 18 amazing lifers.  Their combined skills would shock you – our country needs to allow them out on parole when it is due because they have skills that we need as a country.  Some of them are even lawyers, accountants, and medical doctors.  Everyone makes mistakes – some of us are caught and pay the penalty.  How many of us have just been lucky and not caught?
In Matthew 25:36 it says: “I was naked and you clothed me, I was sick and you visited me, I was in prison and you came to me.”   This is what Christmas really means – giving of yourself for in doing so, you give to yourself.  I am not doing this out of duty, but because I want to.  I always do what I want to do when I can. Chronic illness is not an excuse to having a life of doing what you want when you can.  I prayed to be well enough to go today and I have woken up well enough to go visit.  Thank you, God.
Most of society sees prisoners or ex-prisoners in a very negative light.  I want to somehow in the future, change that view to one of compassion for these people who are doing their time for their crime.  If God can forgive them, if they have done their punishment; then what right do we have to be judgemental?   I am not a fool and I do not think that all prisoners are wonderful, but most of them have accepted their punishment and are making good on the courses offered to help them to change and become better people.   Even when no courses are available at the prison, they find ways of becoming better people by running book clubs and teaching one another the life skills that others have not got.
The sick are visited, the naked are clothed, but how many of us visit the prisoners?  A negative attitude to all prisoners comes from a lack of knowledge, a lack of care and a total lack of compassion.  Please spare a prayer for the prisoners of our country this Christmas.  We need to be more forgiving and more compassionate. 
I wish you all a very happy and safe Christmas and may 2018 bring you everything you need, and a little more so you can give some away as well.

Gentlemen - it was never about the money - I used that to get the info we wanted out of him. (info I wanted out of JK).  All I asked him was "How much would it cost for you to get EdK out on parole tomorrow"  JK thinks I am stupid and I prefer to keep it that way. 
I read that you say it is not prudent to change lawyers now Ben.  However, there is no harm with two or three other clear thinking lawyers having a look and giving another opinion. (and they are not charging us/me)  I will revert with the responses later today.  In the meantime let us see if JK allows me to speak to EdK at 4.30pm today as promised.  A few  members have asked me where they can pay money in for E.  I gave them  the original account that Miempie gave. xxx
(This is what used to piss me off with James Marx – he was always the echo of Ben.  If Ben said jump, Marx would do or say the exact same thing.  What use was he really?  He would even delete posts of mine, without even telling me the reason.  I felt that he had absolutely no respect for my intelligence.  He pissed me off regularly)

Now I realized we were dealing with a crooked lawyer (asking for money when he had said he would do it for nothing in exchange for the media coverage he would get) and secondly, we also now knew that the advocate was not charging us either.   The phone call that JK promised me that EdK would make from his office never happened.   I was right about JK being slack and no one knew that he was also representing Clive Derby-Lewis at the same time.  For sure, EdK did not know that.  What kind of lawyer were we dealing with?  Between visits from ANC to my bedroom, and phoning the presidency daily and writing letters, I was looking for a good lawyer that could take over from JK.  I did not know how I would do that without EdK’s knowledge but I knew I would find a way.
Back at the prison, Eugene got to see the Mama family which got a lot of coverage in the media – this being one of the conditions why Eugene’s parole had been denied.  The Correctional services had not completed the necessary forms of those victims that Eugene had seen, and JK did not check his papers before going to court.  Eugene had to spend more months in prison because the Department of Correctional Services and JK had not done their jobs properly.
Our small, but effective Operation Free EdK was itching to go, but we decided to wait until the next hearing.  If Eugene did not get parole, we were going to take him out ourselves.  Every eventuality was in place. (No one knew of this – not even Ben).  I think if he had known he would have flown to SA to put masking tape over my mouth.
I was also having financial problems that came with my health issues during this time, and Jim Hooper sent me some money to use for myself for medications.  How or who started the rumour that I was piggy backing on Eugene to make money for myself, who knows?  But I had already enough enemies in PP, JK and TM for any one of them to start this shit.   I spoke to our alternative lawyer, Conrad Kruger, who never asked for a penny and he took over.  We used Eugene’s brother, Vos, as the conduit to enter into the fray to find out about Eugene.  The silence surrounding Eugene was ominous.   Through one of my sources I heard that persons unknown had removed Eugene from his cell three days before the Minister of Justice and Correctional Services Michael Masutha Judge withheld parole for Derby-Lewis but gave Eugene de Kock parole.   I therefore know the outcome of the decision but even this was not shared with anyone.  This is how I knew “The train has left the station”.   It was therefore no news to me that parole had been granted.
However, when no one heard from Eugene, and I had contacted TM and JK and they had not heard, my mind did summersaults faster than my stomach.  How easy it would have been to take him out?  Both TM and JK placated me with “he is out on parole” so there is no need for any more lobbying.  I was frightened for his safety and a few days later I again contacted JK to find out where exactly Eugene was and who were the people who had removed him from his cell three days before he was officially given parole.  He did not know which means that he was not on top of the case.  With my urging, he agreed to try to find his client.  Well, what do you know – straight to the media it went (his payment).  He was given parole on the 20 January and yet, not one person knew where he was.  By March, I was beside myself with worry and got hold of JK to do something about it immediately.   He seemed quite calm and unperturbed but he did make sure that his name was again in the newspapers.

Johannesburg - Eugene de Kock is out of jail but still in custody. In a situation reminiscent of apartheid-era activity, De Kock has apparently been secretly handed over to the security forces for indefinite detention.Now his lawyer is planning to use a legal weapon not much used since the apartheid era’s mass detentions – a writ of habeas corpus, which is a demand to the authorities to produce a missing person in court so that the court can decide whether his continued detention is legal.Eugene de Kock's lawyer is still trying to find him. (Great comfort from the lawyer JK)This week, the Ministry of Justice and Correctional Services, the State Security Agency and the SAPS would not talk about what has happened to De Kock.His Pretoria lawyer, Julian Knight, doesn’t know where he is but has received instructions from him, asking for help.“We are instructed by our client that, to date, he has not been released from custody and has not been handed over to Community Corrections to commence his parole.
“Our client also advises us that he is currently being held against his will,” Knight wrote to Minister of Justice and Correctional Services Michael Masutha on Tuesday.
Knight demanded that De Kock be handed over immediately to the Department of Correctional Services’ Community Corrections section, which oversees parolees, given his parole conditions, and that he be released on parole.
“Should you and your department fail to accede to this request, we hold instructions to proceed to court on the basis of urgency for a writ of habeas corpus,” Knight said in his letter.
It is understood that De Kock is being held by security services in a house on the pretext of an undefined threat against him, with no indication of a release date.Protective custody normally requires the consent of the person involved.“They said initially that he was in protective custody because of a so-called plot against him,” Knight told The Star.
“His cell is locked with all his belongings still inside. This is not indicative of a person released on parole… All the paperwork at the prison indicates that he is in the care, custody and control of the SAPS; they have signed responsibility for him.”
While in jail, De Kock has routinely helped the prosecution services with attempts to resolve cases of those who went missing during the apartheid era.
De Kock is a former police officer who commanded the apartheid police hit squad based at Vlakplaas.He was sentenced in October 1996 to two life sentences plus 212 years for offences including murder.On January 30, Masutha announced at a public briefing that he had approved De Kock’s parole.This followed various parole applications by De Kock and court action demanding a decision from the minister. “In the interests of nation building and reconciliation, I have decided to place Mr De Kock on parole,” Masutha said at the time. “He has requested that the actual date and conditions of his release should not be made public. I have acceded to this request.” The decision about keeping De Kock’s release details secret appears to have made the secret handover possible. It is believed he was handed over before the minister’s announcement on his parole. The SAPS did not respond to requests for comment on whether De Kock was in its custody.The State Security Agency referred all queries to Correctional Services.The Ministry of Correctional Services would not comment either.“We have acceded to Mr De Kock’s plea to not give details of his release, so no media enquiries will be entertained on his release except queries on the minister’s decision on his parole,” said ministry spokesman Mthunzi Mhaga.
Now there were rumours that I was using Eugene to feather my own nest.  I was very upset about it.  Not one penny had I taken for myself and it had in fact, not only cost me time over many years, but had also cost me in postage etc.  And on top of all that, I had a niece of Eugene’s giving me a tough time via inbox because she SO LOVED pp and “I had vokol te doen met die familie”.  I wondered where the hell she had been all those years.    I have a big mouth but a very sensitive heart so her bashing me and on top of that being accused of taking money for Eugene for my own use was very soul-destroying for me.  I remember crying bucket loads of tears because of that.  It was during one of these very tearful phone calls that Hannelie  told me about Conrad Kruger.   I even remember that Hannelie gave me some airtime and that we talked while I was in hospital in Bloemfontein.  Three months after his release on parole, no one had heard from Eugene, not even his brother, Vos. 
Conrad said he would take on the case and represent Vos, and in that way, find where Eugene was without JK getting his cock in a knot.  Of course, I was also upset about being accused of taking money meant for Eugene.

EUGENE DE KOCK - PART 9

The very sad part of this story is the fact that we had to destroy everything ever written on our group about Eugene.  I felt that it was an unfair request given the timespan we had to do it in.  Without those details, it is difficult for me to remember everything that went on.  Although I remember a lot, it would have been better if we had those posts as a reminder of what went down.  Even still, Eugene could now have seen how hard we worked for him and where TM, JK and PP entered the game.   Ben believes that Eugene knows what he is doing with the previously mentioned people, but I do not agree.  Eugene has been institutionalised and he is a very private person – who would he or could he have trusted other than those three who popped up long after the dance had started.
I now have to rely on the emails to remind me of all that happened.  When one is in the middle of a war, we don’t remember the individual bullets and that is what has happened to me.
JK was pushing hard for money from the group.  On the 21 April 2015, I received an email from JK.  I am going to type out the email so that you can see what a slimy character we were dealing with.
Hi Dianne
Please see the email that I sent to Piet Croucamp.  I was under the impression that the was handling the money situation.  I double whether there is sufficient money to cover the total bill but what I suggested was that we see how much has been collected and then negotiate with counsel regarding his fee.  (All the fees were for the state and not for the advocate nor JK.  I have dealt with many parole hearing issues and have never heard of a prisoner having to pay) As for the last weeks work Gene had R10 000.00 paid in (by us)   R1000.00 went (sic)the sheriff for urgent service and copies.
Counsel and I spent 2 full days in court.  This excludes the drafting the day before.
We are meeting with Gene tomorrow.  I however don’t know what is going on and still have not received his parole conditions.
In short I don’t know what to say about getting Gene out and what we will still need to do.  I am enclosing for your information a copy of the Application.  I look forward to hearing from you.  Best regards, Julian”.
One of the emails he forwarded to me was dated 13 February 2015 which reads:  “Dear Piet, Advocate Roelof Du Plessis contacted me to ask what the situation was with regard to the payment of his account or a portion thereof is.  Can you please let me know what the situation is regarding this.  Best regards”
On 21 April 2015, I sent an email to Ben Kruger, Dewaldt Louw and James Marx.  “Gentlemen, I have got this out of JK by playing his game.  Please peruse everything carefully and remember that the last application – the costs went to the state. (why then was he asking for money when the state paid for the parole hearing?) I have forwarded all the legal documents to another criminal lawyer who has been in practice since 1991.  He knows E personally and was with him as a policeman at Vlakplass.  I will hear from him later today or night with how we can proceed”.  I then attached the documents showing that Clive Derby-Lewis was also being represented by JK (and I had been told that EdK had specifically requested that JK not represent any other person) and that the money requested was also for Derby-Lewis.
Ben’s response to me was:  “There is just no more money. Period.  Piet Croucamp is welcome to raise whatever he wants, but as far as I am concerned our group has been tapped dry.    Ben had not given much thought to the attached papers and answered me too quickly.  Thus, I had to explain in my next contact with him.
“Ben…but this game I played to get this info out of JK. All I said is that Piet does not hold the keys to the group or the money. The money is not the problem – the problem is for us to get someone else to take over because JK obviously does not give a continental shit.  Even his argument (in my limited knowledge) is flawed in the papers.  Apart from that – how the fuck could he charge the charges he has charged??
Please go through the documents careful and give me a way forward.  If we do not get JK removed and someone else onto this, we may as well wave goodbye to Eugene.  See us all back in the same damned place in six months time.  MC
This was a very busy day for me – the 21st April.  My next message to the gentlemen after I researched case law was this, “…it is the legal documents that go with it that is of concern to me.  How to get him out without JK being involved.  How do I get E to fire JK.  I have someone who can go and be at JK’s offices tomorrow when E is supposed to be present – but I don’t trust the time frame and therefore need someone to sit there with JK until E arrives and before they go back to court.  I have a criminal lawyer who is prepared to take on the case tonight after he has perused the documents…was all geared up to go this morning and now I can’t even get out of the fucking bed.  I am so frustrated with this”.
It was at this point that we hatched the plan to pull Eugene out and no one knew about it, least of all Ben, Dewaldt and James Marx.
Ben did send me a rather telling email “…and remind him (JK) that he told Piet Croucamp  in the beginning that he would take the case for free because he will get a lot of publicity if successful”.   Ben did not think it was prudent to change lawyers at that stage but I knew that we would lose the parole hearing – which is exactly what happened on the reasons I thought it would happen.  So back to prison went Eugene.    And now Ben told me that I could tell JK to go jump in a lake … I wanted him to drown.  I am not a lawyer but I had spent 7 years on this case so I was very clued up on the parole process – I knew that JK had fucked up and that Eugene was going to go back to prison.  I was right but it gave me no satisfaction because we were back at square one.  I was frustrated and angry because I knew that JK was fucking up big time, I could not get to see EdK myself and all his visits were being controlled by TM, PP and JK.
In the meantime, Eugene was being used by the prosecutors to sort out cold case files. He was taken out of prison by the prosecutors a number of times to help them.  Sadly, after I was asked to remove all trace of Eugene on FB, I also, once he was properly free (and I will explain that properly later) I destroyed the photographs that I had of Eugene when he was still in prison with a group of prosecutors.
I still get very angry when I hear the words “prime evil”.  He deserves a pardon – even if he is out on parole (and who knows what those conditions are apart from him not being allowed to speak to the public?)   Eugene will unfortunately never know how hard and how many people were rooting for him.
When I was first asked by JK to remove the FB group, my response was “Not a fuck.  Not until I hear it from the mouth of Eugene de Kock myself”

EUGENE DE KOCK - PART 7

First let me tell you why we have not heard from Eugene.  He has been guarded with four guards 24/7 and has been unable to do his own thing; hence his two hour incarceration in prison the other week.   He was trying to get himself out of this “witness protection” process and actually be as free as he can be, given his parole restrictions.  This time, JK came to the rescue.  I do not know if JK was paid or not.
The real reason Eugene has not contacted us, even those who he are closest to, is two-fold.  First there was his 24/7guards and then there is his idea that if he makes contact with us, it will make life difficult for us and he is trying to protect us.  Well, bless his heart, but I don’t need protection.
The more time that went past, the more crap that I was getting from JK regarding Eugene (because he said a lot of words that meant nothing), the more frustrated I became.  Then a few of us pulled together to free Eugene ourselves.  The integrity of these few people who were prepared to put their lives on the line to free him speaks volumes.  We knew the difficulty, we knew the layout, we knew the problems we would encounter and we knew the punishment or otherwise that we would be facing if the plan failed.  It is so sad that this part of the story never got to reach the ears of even Ben – there are people out there that were prepared to bring Eugene out of prison and hide him for an indefinite period of time.  That I call determination and dedication to make sure that one of our soldiers were not  left behind.
A lot of energy and organising went into that.  The only thing I told Ben was that “I think we should go in and take him out ourselves”   He nearly had a heart attack on the spot.  “Don’t even think about it MC” he said – giving me the same story of how close we were to his parole.  I, of course, was happy to run with it, but only until a certain date.  If the judge did not grant him his parole, we were going to take him out ourselves.  It was a decision that had already been  taken.  Every single thing that I had tried had not worked, so the final deadline was the judgement of the judge at his final parole hearing. 
For those who do not remember, there were many parole hearings and the reasons that they were denied were varied, but the one just before the last one is what sent our blood pressure soaring.   The reason given was that he had not spoken to all his victims.  That was a blatant lie.  The fact that the Correctional Services had not made adequate note of his dealings with his victims was a disgrace.  For me personally, I felt that they were using Eugene as a scapegoat for everything bad in a white man while Mandela was being paraded around as everything good in a black man.  To think that the highest decorated policeman ever in South Africa, Eugene, was languishing in a prison for no other reason than political and racist reasons was abhorrent to me.  Our plan to hijack and hide Eugene was fool proof – no one would ever have found him.   In retrospect, I am sorry we did not go through with our plan.  The prison conditions were appalling.  He was often ill with flu or bronchitis and his eyes were a constant source of concern.   Giving what went down from before the final announcement by the judge on his parole, I truly am sorry we did not take him out ourselves.  At least then we could have nurtured him and given him space and time to heal without guards, TM and PP hanging around.
JK was still calling me and asking me for money to pay the outstanding bill. And because I was pretending to be doff, I asked him to email me the statement and I would discuss it with our committee to see if we had enough to pay him.   He was evading the actual amount, but the following emails are the kinds of emails I was getting; trying to show me that huge amounts of money were outstanding.   I also found his approach to the parole conditions completely wrong – I made it my business to know the law on prisoners and parole so it did give me some right (although I only voiced this to Ben) to say that I believed he was fucking Eugene’s chances up.

As for the last weeks work Gene had R10 000.00 paid in .R1000.00 went the

First let me tell you why we have not heard from Eugene.  He has been guarded with four guards 24/7 and has been unable to do his own thing; hence his two hour incarceration in prison the other week.   He was trying to get himself out of this “witness protection” process and actually be as free as he can be, given his parole restrictions.  This time, JK came to the rescue.  I do not know if JK was paid or not.
The real reason Eugene has not contacted us, even those who he are closest to, is two-fold.  First there was his 24/7guards and then there is his idea that if he makes contact with us, it will make life difficult for us and he is trying to protect us.  Well, bless his heart, but I don’t need protection.

EUGENE DE KOCK - PART 6pp

I never received the letter below – I only received a copy of it closer to the time that Eugene was released.  It was on this letter that I was being advised by Ben and Marx (and always Miempie in the background not wanting to be involved but being involved anyway.  That is why I could say to Ben and Marx, “Fuck that – I will do what I want and if Eugene phones me then I will shut up and until then I will not be stopped”.   Miempie visited EdK from the beginning of his imprisonment .  She was the one person that EdK could have trusted and not TM because he only started visiting EdK three years before his release.  I worked on this case for 7 years.   This is also why I have little time for PP.  She came in right at the end and for her own selfish needs.  I felt throughout his incarceration that the enemy (those working not in his interest – in this case TM) was manipulating the visits and no one was doing things (other than the women I spoke of previously) solely on compassionate grounds.  Everyone who was visiting was there for some bizarre and obscure reason, but NOT for the benefit of this lone prisoner.   And it made me de moer in.  On the many occasions that Ben and I spoke to one another, Ben would always tell me that Eugene was not stupid and that he was in control over TM, PP & Co.    But I knew what an institutionalized brain does to a person – I knew what isolation does to a prisoner.   And that is why I was getting so frustrated with these people who appeared to be doing good and all the ‘thank you’ that landed on our page lauding their service to Eugene. 
To this day I believe that those who have surrounded him (other than the four guards who monitored him 24/7) are not genuine.  The period between May of 2015 and January of 2016 was an exciting and nail-biting time for Ben and me (by this stage I was only tolerating James Marx – he was there only because Ben put him there.  I would never have chosen such a person.  I am a good judge of character and it was proved at the end that James Marx was not the kind of person we needed on board)  It was James who would delete my posts because I was being too truthful.  Well, fuck him now.
Here is the letter the others got that I only saw around December 2015.

FACEBOOK GROUP : FREE EUGENE DE KOCK
1.      The writer hereof acts on the instruction of Eugene Alexander De Kock.
2.      We confirm that you are the administrators of the Facebook Group “Free Eugene De Kock” and this letter is addressed to you in that capacity. (Wonder who he thought I was? So unimportant to them that he could not even address a letter to me)
3.      Namely the
4.      Our client wishes to keep the conditions of his parole confidential but also wishes to thank all of the members of the Facebook group for their assistance and support in the past.
5.      Our client has further instructed ourselves that it has come to his knowledge that the Facebook Group is being used for the purposes of collecting “legal fees “for his release, subsequent to the date of his release namely the 30th January.   (It was Knight was squealing for money via his phone calls to me – telling me that his account was outstanding of R20 000.  However, the advocate had done all the work pro-bono.  Further to this, it was an agreement that Knight do the work for nothing based on the fame he would achieve by taking on a prominent case of a legendary man).
6.      Dianne Lang advised the writer hereof that deposits had been made up to the late of the last Application some two weeks ago.  If this is the case all Fundraising must now stop. (Funny how you know this and it is in May 2015 but release date in January 2016.  When he spoke to me he asked me how much money we had.  I did not know as Miempie controlled the monies coming in and only paid out on instruction from Eugene.  Further to this, Miempie always let one of us know so that we could put a thank you onto the page for the donor.  JK was looking for money to pay the legal fees of the Advocate because the advocate had not been paid a cent yet.  He was very adamant and demanding on the numerous times he called me asking for money – more on the money issue later)
7.      Further to the above, to (sic) our client is concerned regarding comments made by members of the site, that the site is currently being used to advance certain political objectives and/or to reflect Government in a negative way.  (What bullshit)
8.      Whilst our client recognises the rights of citizens to express their views, he is uncomfortable with these views being expressed in his name or that he be associated therewith.
9.      You will no doubt be mindful of the political sensitivity that our client enjoys given his background and the offences for which he was convicted and his conditions of parole.
10.  In the light of this, it would seem that the purpose of the Facebook Group, to free our client has now been achieved and it is our client’s view that there is no further need for it to continue.
11.  We would be pleased if you would kindly advise ourselves what the attitude of the Administrators are with regard to the closure of this Facebook Group is,
Failing which our client will be compelled to take this matter up with Facebook.

EUGENE DE KOCK - PART 5


If you have only joined the story now at Part 5, I suggest you go back to Part 1 and read because certain people had certain code names.   Another thing, enough time has gone by that what I share makes no difference at all.  We are still (I hope) a group with integrity and compassion – although there is always a rat in the mix.  I hope that the rats get trapped into cages never to see the light of day. May they experience even one third of the trauma that Eugene de Kock suffered in prison. 
In May2015, it was discussed (between me, Ben and Marx) whether to start slowing down the nagging and letter writing process regarding Eugene de Kock’s parole.  I cannot remember the words verbatim, but it went somewhere along the lines of it being dangerous/political and maybe detrimental to Eugene; and maybe we were making it more difficult for him.   Now I have never met Eugene, except when he phoned me many months later… but that is another story.    It was suggested that I temper down my posts and try to stay calm and smooth the waters.  Well, me being me, I thought that was for the birds and balls to the wall I said “Not a fuck!!!  We carry on until Eugene de Kock tells me with his own mouth to stop”.   From that date to the date when the world heard about his parole – a million and one things happened.  I could write a book on it all that would make Jansen’s book pale in comparison.  It was cloak and dagger – there were spies, double-agents and spooks.  I did not even trust Ben and certainly did not trust Marx – We all had our own informers in various places.  So I would act dumb until I was told something of an extremely sensitive nature and would very calmly say, “I know – I heard it week before last”.  Shit, I loved doing that to the main dudes that counted.
I was not getting better and spending a lot of time in hospital.   Eugene’s story because the reason for me to get up in the morning.  Often, it was my dedication and hate of injustice that pushed me to  the point of exhaustion…straight back into hospital… but would at the same time move me back into the stream of life.  My life has always been to live for something bigger than myself, and Eugene’s situation was indeed bigger than myself.  Not for a moment did I believe that I could have taken that small little group of three to where we went and how we got there.  It is very sad that we were forced to delete everything from our group page because that would have been a fantastic book.  But more on the reason for that will be revealed at a later stage.   I was driven and determined.  I could not let one day go by without doing some research, making one phone call, writing another letter, motivating the group or speaking with the president’s office.   I entertained officials of the ANC in my bedroom – begging and pleading for a pardon or at least a parole.   I knew things long before anyone else, although Ben would get direct info on Eugene; I was getting info from the political sphere.   The story gets more interesting from here – so stay with me while I spill the beans on treacherous behaviour from where it was least expected.
