The Modus Operandi of the Trial of Heinrich van Rooyen

Adv. Terry Price
For reasons which become obvious by going through the court records and the letters from Lunen Meyer to Mr van Rooyen during the investigation and the trial, Lunen Meyer persuaded and coerced Mr van Rooyen Snr to postpone the case so that Adv Van Der Vyver could be available for the trial, knowing that Trollip and his henchmen had worked hard to tamper with evidence in the Inge Lotz case in Cape Town in which Adv Van Der Vyver prosecuted and lost the case.   The same modus operandi took place in Heinrich van Rooyen’s trial and it is remiss that the defense team of Adv Terry Price lost the case, as the defense team won the Inge Lotz case and the accused walked free.  Heini’s trial was a travesty of justice created by all those involved in the investigation and the trial.  The trial judge, Adv, N Erasmus was biased and unreasonable - another human rights abuse.  Too much emphasis was also placed on the fact that Heini danced, went out with and was friendly with white girls, causing the trial to have an undertone of racism. This too is a human rights abuse.

The Incompetent Defense of Heinrich van Rooyen

Jessica Wheeler murdered in 2005
I am going through the court records of Heinrich van Rooyen who was sentenced for life for the murder of two girls in Knysna in 2005.   This is just about one of the girls.  Jessica (pictured on the left) was first found lying on her stomach.   In all the court records as well as in the Judge's summing up, he accepted that she was found lying on her back.
The defense never called the State's witness, Investigating Officer Trollip, as a hostile witness because had they done so, the entire case that they had built to frame Heinrich would have tumbled down around their heads.   Nowhere do they talk about the fact that the crime scene had been trampled over by a number of people and cops before the so-called official photos were taken?   Who was the policeman who first took pictures of her lying on her stomach and why did those photos never came to light?  Or that she had been turned over and her jeans thrown over the upper part of her body before taking the pictures?    The jeans were laid out on her bum and legs while she lay on her stomach.  The autopsy states that she was asphyxiated by ground which was found in her mouth and pharynx which stands to reason because she was found on her stomach.    Heinrich admits that he and Jessica had been having an illicit affair because he had a common-law wife and she had a drug cop as a boyfriend for whom she was an informer.    Heinrich also admits to having consensual sex with her on the wall behind the club and the phone records of both Jessica and Heinrich were not answered or used for the time period that Heinrich said they had sex.  He stated that he did not ejaculate into her vagina, but outside of it.   This is the reason why no DNA or semen was found inside her vagina and that some was found on her panties.   If someone sodomises another, do they take the time to put the panties back on?  The court accepted that Heinrich had sodomised her because she had two small cuts of 0.75cm to the anus - which could have been caused by constipation but they would be larger cuts if she had been sodomised.   The defense just allowed this to go over everyone's heads and did not bother to cross-examine properly.   When the person who did the autopsy was questioned in court, she could not say in which order she took the specimen of the semen; whether it was first on the outside and then on the inside or vice versa.  It is very easy to contaminate evidence by inserting a sample stick into an anus, bypassing the outside.  But the judge accepted that she had been sodomised and declared that the defense was just 'kicking up dust".   Why did the judge and state not accept the eyewitness account of Kiewiets?  Kiewiets saw two people who he actually named.   Why did they boost Minnie's eyewitness account when he said he drove past and saw (between 2 and 3 in the morning - and taking his eyes off the road) a white girl and a coloured man with wavy hair as gospel truth?   Minnie also declared under oath that he was driving a 5-ton truck but the owner of the bakery for which Minnie drove, never owned a 5-ton truck.   The irregularities from the investigating officer Trollip with his tampering with evidence and re-writing affidavits, the judge who was biased and accepted everything the prosecutor said and the incompetence of the defense advocate Price, has put an innocent person in prison for life.

Why is the Third Knysna Murder Never Mentioned

I have just read the affidavit from the court documents by Mashidiso Petrus Mokgosi, Snr Superintendent of the SAPS. It was made inadmissible in court (who decides what is admissible and what is not admissible?) but contains some valuable information regarding the link between the murders of Peter McHelm and Victoria Stadler. Why has so little emphasis put onto the murder of McHelm and so much on Victoria? Was it because they wanted Heini to be the serial killer of the two girls in Knysna? Was it because they found McHelm's car in Moses' possession so they automatically assumed that Moses was the murderer of McHelm and completely ignored the possible link between the two murders?
This is my opinion after reading this affidavit a number of times.  Moses and Kamoti asked a girl (allegedly by the name of Lucinda/Candace Damons) to lure Victoria Stadler to them.  Moses, Kamoeti and Peter McHelm had been drinking and driving his Polo VW which he had hired from Avis.  At some time he parked his Polo.  (Remember that Mavis from the garage had seen Victoria Stadler with three men in her golf in the early hours of the morning putting R50 fuel in the tank)
Moses, Kamoeti and Peter McHelm raped Victoria and murdered her.  They thought Peter McHelm would go to the police so he had to be murdered as well.  From the document I understand that the girl Candace or Lucinda Damons was the informer who would only speak with a specific policeman but later spoke to the Snr Superintendent above,  and was wearing Victoria’s earrings at the time of the interview by the above-mentioned Snr Supt.
The affidavit also mentions that Heini was the prime suspect (how did he know) and that the others who had been interviewed were not suspects (again how did he know)

Witness Statement Discrepancy in Jessica Wheeler Murder

Heinrich van Rooyen - framed
Alan D Elsdon’s book, Broken & Betrayed  (pg 279 – 282) describes the affidavit and the witnessing by JP of Victoria’s murder.  JP is the son of Mr Kobus Mienie, the bakery van driver who allegedly saw Heini at the churchyard in town in the early hours of the morning of the murder.  According to affidavits and cell tower reports, Heini was at home at Hornlee at 2.25am on the morning of the murder so could not have been at the crime scene at the same time.  According to JP, his father murdered Jessica.  Heini allegedly held Victoria’s legs while Kobus pinned her to the ground on her stomach, with his knees in her lower back and his hands on her head.   Thereafter, he made a phone call at around 3am in the morning.  Now if this call was made at 3am, and Heini was at home at 2.25am, he cannot have been at the crime scene.    JP did not take a polygraph test.  Heini also allegedly had a red top on.  He actually wore a grey Nike top.  His red jacket he had forgotten in the nightclub “Stones”, which he collected the next day.  JP was 14 years old at the time and the affidavit taken by Alan was ten years after the fact.  JP also did not do a polygraph test and it is a known fact that JP is a drug addict and has a criminal record that is fairly long.
JP’s statement contradicts the car-guard, Jaco Kiewiets’ statement and who passed a polygraph test according to the first private investigator on the scene, Christain Botha, in his book, Search for Truth.
Franklin van Rooyen actually introduced Alan to JP and JP never said anything to Franklin that Heini was at the crime scene at the church yard.   JP's father, Kobus Mienie and Inspector Burmeister (SAPS) are family and he knows everything about JP and Kobus’s involvement in the drug-trade.
In 2010 an inmate also gave a sworn statement in front of a magistrate in Mosselbay confessing his involvement with the Victoria Stadler murder in Noetsie forest and the police and NPA dismissed it as well.

Why Heinrich van Rooyen Smiled when He was Sentenced

I asked him "Why did you smile when you were sentenced Heini?

He answered - "If I did not smile I would have cried.  I had to think of something to make me smile.  The judge said that if the death penalty was still enforced in South Africa he would have no hesitation in giving me the death sentence.  And I thought to myself "And you would be sending an innocent person to his death".  Then he gave me two life terms and 28 years and I thought ... they have screwed with all the evidence to make me appear guilty but they have not managed to find me guilty of setting the car alight and those extra years is for malicious damage to property".

I have been in prison for 12 years.  I have to keep hoping because without hope no one can live inside like this.   I have to pin my hopes on Alan D Elsdon who is trying to get the police to re-look at the corruption and the perjury of the detectives in my case.  Christian Botha, the Private Investigator, does not believe I am guilty. Why would I rape and murder women who were available to me.  And why just two of them ... if I were a serial killer then surely I would have gone on a killing spree.  I can't even kill a chicken.

I am sentenced to life in prison without the right to appeal for the killing of two girls I knew.  One, Victoria, I had only met a few days before and I played pool and danced with her.  She gave me a lift to the entrance to the suburb I lived in. The other, Jessica, I was having a clandestine love affair with.   She had a boyfriend and I had the mother of my children.  Neither of us wanted our partners to know about it".

If we had a jury system as they do in England, Heinrich van Rooyen would NEVER have been found guilty and the police who perjured themselves would have found themselves in prison.

Heinrich van Rooyen - The Don Juan

We have the affidavits and the eye-witness reports proving that Heinrich van Rooyen is not guilty of the murders of Jessica wheeler and Victoria Stadler in Knysna in 2005 (see diannelang.blogspot.co.za for details – Horrific Details of Stadler’s last hours show Heinrich van Rooyen is NOT the murderer).
The Judiciary say that we must get the police to investigate.  The police say we must go back to court.  And in the meantime, an innocent person has been in prison for 12 years.   The ineptitude of both the police to investigate their own corrupt police who framed Heinrich and the judiciary who gave him 2 life sentences and 28 years without leave to appeal is beyond belief and completely unacceptable. The 28 years was for malicious damage to property and rape, neither of which Heinrich is responsible.  He did not rape anyone and nor did he set the vehicle of Stadler alight.
However, it is we, the public, who are the ones who can make this change by shouting loudly from the rooftops that the behaviour of the police and the justice system is corrupt and incompetent.  It is our taxes that pay for this service and we are the ones who must call the shots.  If we say nothing and do nothing, then we are saying that their behaviour is acceptable and that it is fine for innocent people to be imprisoned.   Heinrich was framed to protect drug lords, cops and businessmen in Knysna.
It has been said that he was not like by a few men before he was put into prison.  Let me explain why this idea is being promulgated.   Heinrich van Rooyen was a Don Juan.  He was a DJ at a popular nightclub and as such, he was constantly in the face of the young population of Knysna and the many tourists.  He was (and still is) charming and could charm that panties off any woman he pleased.  Why would someone who was constantly being solicited and offered kisses, oral sex and intercourse on a plate, rape and murder one or both girls.
It makes no sense at all for a man who is offered sex at every opportunity to have to rape someone, or even bother to murder the female afterwards. All the young women, including Jessica and Victoria, were constantly vying for his attention.   It is my opinion that the men who said they did not like him before he went to prison were most likely jealous of the attention he was paid by young females.

Being a Don Juan does not make you a murderer!

Horrific Details of Stadler's last hours show Heinrich van Rooyen is NOT the murderer

...A teenager serving a sentence for theft and housebreaking has come forward with horrific details of what he claims were Stadler’s last hours on 10 November 2005.  He says he was present when the terrified young woman was gang-raped, chocked, doused in petrol and stabbed …
And he claims her attackers were not van Rooyen, but three men, one of whom was a drug lord for whom he was a runner.
The inmate’s statement to a magistrate could exonerate van Rooyen of one of the murders and implicates the prominent drug lord currently serving 20 years for murder.
During the trial, van Rooyen maintained his innocence of both murders and fingered two other Knysna men and an alleged gangster as the likelier suspects.
Christian Botha, the private investigator on the case said that not only did the police fail to investigate the murders thoroughly, but built a case around van Rooyen, having decided he was guilty from the beginning.   He also visited the inmate and said that the youngster showed knowledge of facts related to the crime that were never made public.
The young inmate was standing at the garage to the entrance to Hornlee on the night of Victoria Stadler’s murder.  He saw van Rooyen kiss and hug Victoria, that he got out of the car and walked away.  Three men then approached Victoria for a lift to Knysna and she agreed.  Sometime later, the care returned with three men but Victoria was not with them.  They bought a can of petrol and asked him to join them.  They took the Noetzie road.  Throughout the trip he heard noise from the back of the car and later discovered that the noise had been made by Victoria, who was tied up in the boot.
Parked in the bush, all four of them smoked druges.  One opened the boot, pulled Victoria out and the three others took turns in raping her.  They partly strangled her, shoved her into the car and then poured petrol over her and the car.
Southern Cape Police Spokesman, Captain Malcolm Poje, said the statement was not being treated as a confession but police were investigating its validity.  Poje says though the statement was being investigated, it was up to the van Rooyen family to appeal to the judiciary for the case to be re-opened.  The investigation was not a formal one, as the murder case had been concluded, he said.
State Advocate Christhenus van der Vijver said any allegations would have to be investigated by the police first.  He would not speculate on whether the matter would return to the courts.  Everything relies on the outcome of the police investigation”, he said.
(Information taken from Weekend Argus (Saturday edition) 24 April 2010 and written by Thandanani Mhlanga)
It seems to me that the police and the judiciary are totally inept and corrupt.  Someone makes a confession that they were an accessory to a crime, but the person is not charged.  He makes the same confession to the magistrate, exonerating Heinrich van Rooyen from this murder but nothing comes of it.  The police spokesperson says it is not a valid investigation and that the family are to appeal to the judiciary but the judiciary say that the police must first investigate.  Everyone is passing the buck, while Heinrich sits in prison for a crime he did not commit.

I am aware that the family approached the Independent Police Investigative Directorate (IPID) with evidence that Heinrich was framed, together with affidavits and proof how Heinrich could not possibly have been the murderer of either Victoria Stadler or Jessica Wheeler.  Alan D Elsdon has worked on this investigation for three years and submitted his findings on behalf of the family and nothing has come of it.   It is a disgrace and a travesty that we cannot trust our judiciary or our police to do what they are tasked to do.   They do as they please with impunity and they protect one another.  With Director Trollip dead, perhaps the IPID won’t mind doing what they are supposed to do and that is to investigate crimes committed by police.  Perjury by police is a crime.  And it is criminal to frame and innocent person.

My Visit to the Man Convicted of the 2005 Knysna Murders

Against the wishes of all those around me, including my doctor, I went to visit Heinrich van Rooyen at St Albans prison last Sunday.  With a little faith in the spiritual universe, I got a lift from another visitor who was going to visit someone in Maximum Security.  Heinrich is in Medium B, so after her telling the Wardens that I was in a wheelchair outside, we parted to go our separate ways.
A bus takes the visitors to the various prisons after having ID checks, but I could not do that for two reasons; one was because the prison is not wheelchair friendly and I could not take a wheelchair on a bus.  A separate vehicle was arranged to transport me to Medium.  However, because the radio was not working at the main gate, I had to wait for the bus driver to deliver a message that I needed to be taken into the prison with a different vehicle.
I sat in the boiling sun with no shade for approximately an hour and a quarter.  I pushed myself to the wardens standing a little distance from me smoking and asked for help to get to see Heinrich.  Within 10 minutes I was collected by Mr Oosthuizen and driven to Medium B.  He was courteous, helpful and friendly and pushed me over some horrendous terrain until I got into the building where he left me in the care of another warden who pushed me into the visitor’s area and called for Heinrich.   The wardens did not know who Heinrich van Rooyen was – they only knew him as Heini which I thought was amazing since he was the prisoner and they his jailors.   I waited less than a minute when Heini walked through the door.   I recognised him immediately and waved him over.
Without hesitation, we both put our arms around one another.  I have never met a young man with so much wisdom, pure intentions, good values and a peaceful aura about him.  He is softly spoken and good looking.  No wonder the girls threw themselves at him when he was a DJ.  He has been running 5 km a day for the last 4 months and exercising.  He has rippling muscles which are easily observed under his orange prison uniform.   Medium prisoners are allowed a one hour contact visit.  The warden who was over-seeing the time of the visits was walking up and down the two rows of benches where the prisoners and their loved one’s sat.  He  would shout out the names of the prisoners who had used their hour visit.   When I asked Heini why he shouted like that, Heini chuckled and told me that it is just his way.   On one of his passes past us, I told him (and this was an honest opinion) that he had the most beautiful blue eyes I had ever seen on a man.  I am sure that he had heard that compliment a thousand times.  Then I asked him not to shout when it was time up for Heini’s visit.  Instead of an hour, he gave us an hour and a half and then just waved in our direction to indicate the visit was over.
That hour and a half flew – it felt like we had been together for ten minutes and yet, it felt like I had known him his whole life.  He is like an open book; no hidden agendas and absolute honesty.  You only have to look into his eyes to see what a compassionate human being he is.  For someone who has been imprisoned already 12 years for a crime he did not commit, he is a very well-adjusted young man, considering his circumstances.  He is filled with hope that his innocence can be proved, and that hope is pinned on Alan Elsdon.    I am completely convinced, after reading all  Alan’s investigation notes and affidavits; and speaking to him in person, that Heinrich van Rooyen is innocent of the crimes he has been found guilty and sentenced for.  He faces 30 years in prison without parole for the murder of two girls in Knysna in 2005.   Alan D Elsdon, ex- South African Police detective and the author of the best-selling book, The Tall Assasin, has uncovered massive police corruption and a concerted effort to cover up the crimes committed by others.   He came across Heinrich’s case while investigating another crime in Cape Town.
I sat listening to this bright young man telling me about all the courses he had done through the prison and through other institutions.  Just one more course to do and then he will have completed every course available on IT.  As I sat quietly listening to him, each of our hands intertwined, I felt the tears sliding down my cheeks.  He let go of my one hand and gently wiped the tears from my face, telling me not to cry.  It took so much strength not to start sobbing – the wasted years, the injustice, the family heartache, the careless lawyer and advocate, the corruption and the police cover-up – all these things bounced around inside the walls of my heart.   And my heart ached for him.
When my visit was over, that warden with the beautiful blue eyes, allowed Heini to push me to the door.  From there, Mr Oosthuizen took over.  I sat up front with Mr Oosthuizen, with three visitors that had to be transported to the prison hospital sitting in the back.  Once they had been off-loaded at the hospital, he took me on a tour of the prison before dropping me back at the gate of the prison.  It is enormous and resembles a village.  Some areas are well looked after and other areas are derelict, dirty and it is clear that no maintenance has been done in twenty years.
My lift was waiting for me, concerned that I was taking so long.  Her visit lasted only 30 minutes because she was visiting her son in Maximum.  On our drive back, she told me about the conditions under which the prisoners of Max are held; including what had happened on Boxing Day when the tragedy occurred.  It is little wonder that the prisoners, through sheer exasperation and frustration attacked and stabbed five wardens.  The number of dead and injured prisoners, after the prisoners had already been isolated, boggles the mind. Even prisoners have rights – they did the crime and they are doing the time, but they need to be treated humanely.   If these conditions do not improve, I foresee yet another tragedy unfolding at St Albans Prison in Port Elizabeth.
For justice to prevail, not only for Heinrich van Rooyen, but also for the two young women who were murdered, we need your help.

Funds are desperately needed to take the new evidence and affidavits further in order to free Heini and to put the real Knysna murderers behind bars.   If you can assist with funding in any way, please go to gofundme-sa.co.za to donate directly via the crowd-funding platform or contact me by email for banking details at dianne.lang1@gmail.com   Every rand counts.
